In this podcast, Ben Gottlieb discusses hostile workplace environments.  This is a concept that was introduced by amending legislation that came into effect in late 2022.  The amending legislation made several significant changes to our workplace laws including that it is unlawful to subject another person to a workplace environment that is hostile on the ground of sex.  It also introduced a positive duty on employers requiring them to take reasonable measures to eliminate as far as possible certain unlawful conduct including conduct that creates a workplace that is hostile on the ground of sex.  It shifted the system from a reactive one to a system where employers are expected to take active steps to prevent harassment from occurring.
