Construction Update Issue 2
18 December 2023In Sparke Helmore’s 2023 Construction Update we reflect on another challenging year for the construction industry in Australia. Insolvencies again featured prominently in 2023, which is reflected in the fact that this topic leads our publication. Also reflective of the current landscape is the introduction of commentary on a range of ESG issues.
In a series of updates, we consider some of the significant legislative and regulatory developments across Australia. The reform process continues, with some jurisdictions continuing to make great progress, while others are still in the development stage.
The disputes section provides commentary on a selection of decisions relating to defects, expert evidence, contractual interpretation, limitations, insurance issues and security of payment claims. We also hear from two leading firms: Beale & Co on construction developments in the United Kingdom and from Duncan Cotterill on lessons learned from the collapse of CBL in New Zealand.
Finally, we have introduced a section on combustible cladding, where we have highlighted two decisions of significance.
We hope you find this issue informative and useful. If you would like any further information on the issues raised in this publication, please contact Kiley Hodges.
