We advise insurers on claims made under warranty and indemnity (W&I) policies, on a range of deal sizes, industry sectors and under both buy and sell-side policies.
We act on some of the largest W&I claims globally and cases involving issues of fair disclosure, undisclosed regulatory action, major projects, historical employee entitlements and tax. Complex coverage and quantification issues are distinct features of claims under this product class where claimants/insureds are frequently sophisticated market participants.
From the outset of a claim, we work with underwriters to understand the background to a deal and to identify the key issues that will arise, including the need for appropriate expert engagement. Our approach is to identify matters that can be resolved at an early stage, and which should be defended. We provide clear and focused advice to inform claim management.
