Why we need to collect your information
We collect your personal information to comply with the ‘Customer Due Diligence’ requirements in the Anti-Money Laundering and Counter-Terrorism Financing Act 2006 (AML/CTF Act). This includes to:
- establish and verify your identity before providing certain services to you or the person you are acting on behalf of,
- assess and manage potential money laundering, terrorism financing, proliferation financing risks or related compliance risks associated with the provision of our services,
- make reports required by law under the AML/CTF Act, and
- meet record keeping obligations under the AML/CTF Act.
We may also use your personal information for other identify verification checks that we may be required to carry out in connection with the legal services we provide to you, for example, to register your transaction through Property Exchange Australia (known as PEXA) and to liaise with ASIC in connection with company / director matters.
In other cases, we may seek your consent to use your personal information for another purpose.
What personal information we collect
We collect the following types of personal information:
- your full name, date of birth, residential address,
- photo ID and unique identifiers, such as a passport or driver’s licence number, and
- information related to the nature and purpose of your business relationship or transaction with us.
For customers that are corporations, trusts, partnership or associations we will collect the following information:
- full name of the company and your ACN/ABN,
- registered office address and principal place of business,
- constitutions, partnership agreements, trust deeds and similar governing documents,
- full name and director identification numbers of directors,
- full name, date of birth and registered address of beneficial owners as well as beneficial ownership information such as which person(s) ultimately owns more than 25% of the entity,
- information about the nature and purpose of business relationships and transaction(s) you are entering,
- where applicable, details of trustees, settlors, appointors and beneficiaries of any associated trusts,
- information relevant to assessing the client's money-laundering and terrorism financing risk such as the nature of their business, source of wealth, source of funds for a transaction, or jurisdictions they operate in,
- information regarding persons acting on the entity’s behalf, including their name, date of birth or address, and
- information related to whether the client, their family members or associates are politically exposed persons under the AML/CTF Act.
We also collect sensitive information such as whether you are a member of any political associations, professional or trade associations may be used to verify your occupation or determine whether you are a politically exposed person.
How we collect your information
We will generally collect your personal information through our onboarding process, and we collect personal information:
- directly from you,
- from and through a third party identity verification and collection service FirstAML, and
- from publicly available registers of companies, trusts, or public records including ASIC registers, court records, regulatory filings, land registries.
Who we may share your information with
We may disclose your personal information to third party identity verification and collection service FirstAML for the purpose of complying with our AML/CTF obligations including identity verification and storage.
We may also share your personal information with AUSTRAC to meet our legal and regulatory obligations under the AML/CTF Act or the AML/CTF Rules.
What happens if we cannot collect your information
If you do not provide us with your personal information, we may not be able to verify your identity and provide you (or the person you are acting on behalf of) with the services you have requested.
