Special update - Road Transport and Other Legislation Amendment (Micromobility Vehicles and Smartcards) Bill 2025

On 16 October 2025, the NSW Government released the Road Transport and Other Legislation Amendment (Micromobility Vehicles and Smartcards) Bill 2025. This Bill sets out a state wide framework for safety and operational standards for bikes, e-bikes and e-scooters across NSW.
Relevant to the CTP Scheme as extracted from the Second Reading Speech:
Amendments to the Motor Accident Injuries Act 2017 will define a micromobility vehicle as an e-scooter or other prescribed vehicles exempt from registration and clarify that injuries or deaths resulting solely from micromobility vehicle use—that is, where no registered motor vehicles are involved—are excluded from the scope of the Act. It also excludes micromobility vehicles from claims against the Nominal Defendant for uninsured vehicle accidents. Amendments to the Motor Accidents (Lifetime Care and Support) Act 2006 will clarify that injuries from micromobility vehicle accidents—where no registered motor vehicles are involved—are not covered under the Lifetime Care and Support Scheme.
There are also some new regulations setting vehicle standards, which require helmets meeting Australian standards to be available on all vehicles (e scooters, e bikes etc). Of course, shared bike riders already are required to use helmets, just like private bike riders. What exactly a “micro mobility vehicle” is is not defined in this Bill due to the constantly evolving nature, but may be in MAIA. The second reading speech says that push bikes and electric bikes are included, at least that’s the intention.
Of course, the Bill may never get off the ground or it may look entirely different by the time that it does. In any event, it is definitely something to keep an eye on given the potential implications on the CTP Scheme in NSW.
