Working towards an early resolution
Managing professional indemnity claims requires a dual focus on the experience of insureds and our insurer clients’ needs. In this regard, we act for domestic, London and US-based insurers that underwrite professional indemnity cover for engineers, architects, designers, certifiers, financial planners, solicitors, barristers, tax advisors, accountants and related financial services professionals.
Clients appreciate our focus on: getting an early and accurate understanding of their exposure; setting appropriate reserves at a sustainable and stable level; and bringing about an acceptable outcome at the earliest opportunity. To achieve these goals, we work closely with insurers, insureds and brokers to unearth the key issues promptly—always mindful of the sensitivities of these matters for the insureds—and agree on a strategy that takes into account the claim’s merits and likely path.
In striving to achieve the best outcome for our clients, we are always aware of the impact of legal costs. We devise early resolution strategies that reduce costs as well as risk.
Beyond claims management, clients seek our counsel on coverage, defence and investigations, complex liability, coverage disputes and damages. We also assist with corporate insurance policy wording, operational issues, risk management, good faith, conditions, exclusions, premium loading and endorsements. During transactions, we advise on insurance clauses, risk transfer, caps on liability and due diligence.
Reinsurers seek our guidance on contract drafting and interpretation, claims advice, coverage disputes, including multi-jurisdictional litigated and arbitrated disputes, commutations and schemes of arrangement.
Clients also ask us to facilitate tailored training programs on the fundamentals of professional indemnity insurance and reinsurance.
