Contract works and material damage policy coverage advice
Wes and his team are advising the local and overseas underwriters subscribing to a project specific Contract Works and Material Damage Policy covering the construction of one of Australia's longest natural gas pipelines.
The matter involves several claims for indemnity by the policy holder and the design and construction contractor, arising from issues with the epoxy coating on the pipeline, the operation of the cathodic protection system and corrosion of the pipe sections. The rectification costs are in excess of $100 million.
Wes and his team are analysing complex issues of policy construction and interpretation, technical issues associated with the presence of actual damage (as opposed to mere defects) and betterment, along with aggregation issues and application of multiple deductibles.
