The Australian infrastructure sector has enjoyed unprecedented growth since the early 1990s, yet the key performance indicator for both suppliers and sponsors remains the delivery of world-class projects within increasingly tight time and budget constraints.
Our team has experience in Public Private Partnership (PPP) transactions, privately funded infrastructure (PFI), and privately financed projects (PFPs). The team also has extensive experience in build-own-operate-transfer projects (BOOT), build-own-operate projects (BOO), design, construct and maintain projects (DCM) and alliance projects for infrastructure including roads, rail and water treatment plants, as well as social infrastructure such as education and health.
The team draws upon the expertise of specialist lawyers within the firm across a number of areas including construction, finance, corporate and commercial law, property, planning & environment, government and insurance.
We act for governments, project sponsors, financial institutions.

Experience
- Advising on and negotiating a 27 year Facility Management Agreement (and associated transaction documents) entered into in June 2005 for the $280m Perth CBD Courts PPP project. This was Western Australia's first social infrastructure delivered under a PPP model.
- Acted for a major rail joint venture in the delivery of the rail spine component of the Southern Suburbs Railway between Perth and Mandurah, including advising on a variety of contract administration issues, such as delay and disruption, prolongation, acceleration and deceleration, variation, partnering, good faith and rise and fall.
- Advised a major rail corporation in relation to the drafting and negotiation of commercial, construction and consultancy transaction documents and amendments to infrastructure leases for the Tottenham Rail Bypass in Victoria.
- Advising NSW Health on the initial transaction documents between the Health Administration Corporation, Hunter and New England Area Health Service and the parties representing the Mater Hospital for the redevelopment of the Mater Hospital and relocation of allied health facilities to the redeveloped Mater Hospital site. This project has ultimately proceeded as a PPP.
